How traditional vendors underpay non-citizen workers…

Amit came to the United States to earn his Master's degree studying Computer Science. An excellent student, Amit’s GPA made him highly sought after during on-campus recruiting periods. He was hired by an IT consulting firm soon after he graduated.

Loss of income.
Amit was earning $20/hr. He soon discovered that his employer was billing the client $80/hr for his service. That meant Amit was earning only 25% of the end client's bill rate for his services.

Some employers will exploit foreign workers by sponsoring their work visas and, in turn, providing salaries and benefits far below market value. Because non-citizens rely on their employers to maintain legal work status, the company has little risk of losing their employee–as a result, there is little incentive to increase wages or provide additional benefits.

How unstable organizations can impact Green Card status...

Dina came to the United States to provide more for his family financially. He quickly found an IT job with a company that was willing to sponsor his work visa.

Company Folds.
During the 4th year of his work visa, his company folded suddenly and unexpectedly. He was unable to complete his permanent residency application and had to find a new sponsor quickly to maintain his legal work status.

Dina had to find a new employer, re-start his application from scratch–the entire process takes at least 4-6 years–and live an entire month without a paycheck or insurance. Most importantly, he had to make sure that his legal status was intact.

Project discontinued.
During the 4th year of his work visa–a foreign worker is allowed to work in the U.S. for only six years if permanent residency is not filed–his project was discontinued and Naresh lost his job. His permanent residency application was stopped and Naresh had to find a new sponsor quickly to keep his family in the country legally.

Amit graduated from an IIT in India as a computer science major. Soon after graduation, he was offered a job working for an IT consulting company in the United States. The company would manage his H1B.

Employer abandons H1B case.
During the H1B process, the USCIS (United States Citizens and Immigration Service) issued a RFE (Request for Evidence) on his transfer. The employer had been negligent managing H1B compliance and was unable to answer the RFE.

If an employer does not answer an RFE properly, the H1B transfer case will be considered abandoned and/or denied. Amit would have to leave the country in 30 days.
